PROFESSIONAL LEGAL EXPENSE INSURANCE
BRITISH COLUMBIA DENTAL ASSOCIATION
SUMMARY
The British Columbia Dental Association has arranged professional fees insurance on behalf of its Members as part of their membership, through NFP.
The Policy is “claims made” meaning that it only covers claims and legal proceedings which relate to incidents after the Retroactive Date and that are notified to the Claims Administrator during the Period of Cover. The Insurer agrees to indemnify the Member to the extent and in the manner provided within the Master Policy.
The Insurer provides indemnity for a maximum of 2 (two) admitted claims per Period of Cover. Where the legal and professional fees on a claim file exceed the amount of $5,000 the member is responsible for payment for any excess to a maximum amount of $1,000.
- Free and unlimited access to a toll free Telephone Legal Advisory Service on any business or personal matter (see hours below).
- Payment of Legal and Professional Expenses for the matters specified in Your Evidence of Insurance and up to the Limits of Indemnity specified in Your Evidence of Insurance.
A fully paid up member of the British Columbia Dental Association, who is in good standing, and has been declared to the Insurer, and who is insured under the Master Policy by the issuance of the Evidence of Insurance.
1.1 Telephone Legal Advisory Service
You have unlimited toll-free telephone access to a lawyer for assistance on any business or personal related matter the following basis:
(i) Core Service is provided between the hours of 8am and midnight, local time, 7 days a week;
(ii) After Hours Service is provided between the hours of midnight and 8am local time, 7 days a week. This service will provide a call back from a lawyer on the next business day;
(iii) For Emergency situations there is access to a lawyer 24 hours a day, 7 days a week.

You authorize the Telephone Legal Advisory Service to disclose to the Claims Administrator dates when You used this service and the general nature of such call, and where You make a claim for indemnity pursuant to the Master Policy such disclosure will include any information pertinent to the claim.
You must notify the Claims Administrator immediately You are aware of any cause, event or circumstance which has or could give rise to a claim which involves You.

You will need to provide your policy number and your Evidence of Insurance number, which is your BCDA membership number, and brief details of the circumstances. A claim form will be sent to You for completion and this must be returned without delay.
You should not instruct a lawyer or other representative to act for You. All claims under all the Insuring Clauses are to be handled by a lawyer or appropriately qualified professional appointed by the Claims Administrator. They are not an agent of, or an employee of, either the Claims Administrator or the Insurer.
Any Legal and Professional Expenses incurred without the Claims Administrator’s prior consent will not be covered.
